Welcome to WHYQ.ca, an online food ordering platform. ("WHYQ", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of our website, mobile application, and related products and services (collectively, the "Services"). By accessing or using our Services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use our Services.
Use of Services
Eligibility
You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are at least 18 years old.
Account Registration
To access certain features of our Services, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
Prohibited Activities
You agree not to use our Services for any unlawful or prohibited activities, including but not limited to:
Violating any applicable laws or regulations.
Infringing on the rights of others, including intellectual property rights.
Distributing harmful or malicious content, such as viruses or malware.
Engaging in fraudulent or deceptive practices.
Interfering with the operation or security of our Services.
Orders and Payments
Placing Orders
When you place an order through our Services, you are making an offer to purchase the items in your order. We reserve the right to accept or reject your order for any reason, including but not limited to product availability, pricing errors, or suspicion of fraud.
Payment
You agree to provide valid payment information and to promptly update your payment information as necessary. We use third-party payment processors to process your payments. By providing your payment information, you authorize us to charge your payment method for the total amount of your order, including any applicable taxes and fees.
Order Changes and Cancellations
Once you place an order, you may not be able to change or cancel it. If you need to make changes or cancel your order, please contact us as soon as possible. We will do our best to accommodate your request but cannot guarantee that changes or cancellations will be possible.
Pickup and Table Researvations
Pickup
Pickup orders can be placed through our website or mobile app. A confirmation email or message will be sent once the order is confirmed. If you choose to pick up your order, you must do so within the designated pickup time. If you are running late, please inform the restaurant. Orders not picked up within 30 minutes of the scheduled time may be canceled. Please check your order upon pickup. Any discrepancies should be reported immediately to the restaurant.
Table Reservations
Reservations can be made through our website or mobile app. A confirmation email or message will be sent once the reservation is confirmed. Reservations are available in specific time slots. Please arrive on time to ensure prompt seating. If you are running late, please inform the restaurant. Reservations will be held for a maximum of 15 minutes past the reserved time. After this period, the reservation may be canceled or given to another guest. Reservations can be canceled without penalty up to 1 hour before the reserved time. Late cancellations may incur a fee. Changes to the reservation time, date, or number of guests must be communicated as soon as possible. We will do our best to accommodate changes, but they cannot be guaranteed. Failure to show up for a reservation without prior notice may result in a charge to your account. For reservations of 8 or more people, please contact the restaurant directly. Special terms and conditions may apply. A deposit may be required for large group reservations. The deposit will be applied to the final bill and is refundable if the reservation is canceled in accordance with our cancellation policy.
Returns and Refunds
Returns
Due to the perishable nature of food items, we do not accept returns. If you have an issue with your order, please contact us, and we will work with you to resolve the issue.
Refunds
Refunds may be issued at our discretion in cases where there are significant issues with your order, such as incorrect items, missing items, or food safety concerns. Please contact us within 24 hours of receiving your order to request a refund.
Intellectual Property
All content and materials on our Services, including but not limited to text, graphics, logos, images, and software, are the property of WHYQ or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works of our content and materials without our prior written permission.
Limitation of Liability
To the fullest extent permitted by law, WHYQ and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your use of or inability to use our Services.
- Any unauthorized access to or use of our servers and/or any personal information stored therein.
- Any interruption or cessation of transmission to or from our Services.
- Any bugs, viruses, or other harmful code that may be transmitted to or through our Services by any third party.
- Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through our Services.
Indemnification
You agree to indemnify, defend, and hold harmless WHYQ and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of our Services, your violation of these Terms, or your violation of any rights of another.
Governing Law and Dispute Resolution
These Terms and your use of our Services will be governed by and construed in accordance with the laws of the province of Ontario, Canada, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms or our Services will be resolved exclusively in the courts of Ontario, Canada.
Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices or applicable laws. We will notify you of any significant changes to these Terms by posting a notice on our website or by other means as required by applicable law. Your continued use of our Services after the effective date of the updated Terms constitutes your acceptance of the updated Terms.
